REGULATIONS OF THE KAiDO INTERNET STORE valid from 2.01.2023

I. Definitions

The terms used in the Regulations shall mean:

1. Customer - a natural person, a legal person, or an organizational unit that is not a legal person, to which special provisions grant legal capacity, who makes an Order in the Store;

2. Civil Code - the Act of the 23rd of April 1964 (Journal of Laws No. 16, item 93 as amended);

3. Regulation - present Regulation of providing services electronically within the KAiDO online shop;

4. Online Shop (Store) - internet service available at www.kaido.pl, through which the Customer may in particular place Orders;

5. Goods - products presented in the Internet Shop;

6. Agreement of sale - agreement for the sale of Goods, as defined by the Civil Code, made between the KAiDO shop and the Customer, executed using the internet service of the Shop;

7. Act on special conditions of consumer sale - Act of the 27th July 2002 on special conditions of consumer sale and amending the Civil Code (Journal of Laws, No. 141, item 1176 as amended);

8. Act on Providing Services by Electronic Means - Act of the 18th of July 2002 on Providing Services by Electronic Means (Journal of Laws No. 144, item 1204 as amended);

9. Order - Customer's declaration of will that leads directly to the signing of a Sales agreement, specifying, in particular, the type and number of Products.

II. General provisions

2.1 These Regulations determine the principles of use of the online shop available at www.kaido.pl.

2.2 These Regulations are the regulations referred to in Article 8 of the Act on electronic services.

2.3 The online shop, operating at the address www.kaido.pl, is operated by KAiDO Dorota Babral-Stankiewicz, Świętojańska 173A/9, 07-202 Wyszków, tel. +48693158383.

2.4 These Regulations define in particular:

a.) principles of registration and use of the account within the online shop;

b.) terms and conditions for electronic reservation of products available in the online shop;

c.) terms and conditions of electronic placement of Orders within the online shop;

d.) principles of entering into Sales Agreements with the use of services provided by the Online store.

2.5 The Customers may access these Regulations at any time through the link placed on the homepage of the website https://kaido.pl/regulamin and download and print it.

2.6 Information about the Goods given on the websites of the Store, in particular their descriptions, technical and usable parameters, and prices, constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.

III. Rules of using the Internet Shop

3.1 A prerequisite for the use of the Online Shop is the registration with it.

3.2 Registration takes place by completing and accepting the registration form, available on one of the pages of the Shop.

3.3 The condition of registration is to agree to the content of the Terms and Conditions and provide personal data marked as mandatory.

IV. Procedure for the conclusion of a Sales Agreement

4.1 In order to complete a Sales Agreement via the Online Store, you must enter the website www.kaido.pl, make a selection of products, taking further technical steps based on messages displayed to the Customer and the information available on the site.

4.2 The selection of ordered Goods by the Customer is performed by adding them to the basket.

4.3 In the course of submitting the Order - until the moment of pressing the button "Order". - The Customer has the possibility to modify the entered data in the selection of the Goods. For this purpose, the Customer should be guided by the messages displayed and information available on the site.

4.4 After the Customer has provided the Online Shop with all the necessary data, a summary of the Order shall be displayed. The summary of the Order shall include information on:

a.) the subject of the Order,

b.) unit and total price of the ordered products or services, including delivery costs and additional costs (if any),

c.) the selected method of payment,

d.) selected method of delivery

4.5 In order to send the Order it is necessary to accept the content of the Regulations, provide personal data marked as obligatory, and press the button "Place an order".

4.6. Sending an Order by the Customer is a declaration of intent to conclude a Sales Agreement with the KAiDO Store, in accordance with the Regulations.

4.7 After placing an Order, the Customer receives an email containing the final confirmation of all the important elements of the Order.

4.8. The Agreement is considered to be concluded at the moment of receiving by the Customer the email mentioned above.

4.9 The Sales Agreement is concluded in the Polish/English language, with the content compliant with the Regulations.

4.10. Orders are executed only after the payment is received.

4.11. The payment term is 7 days. Failure to meet the deadline results in cancellation of the order.

4.12. All prices given in the KAiDO Store are prices expressed in Polish zloty (PLN).

4.13. All products from the KAiDO Store range i.e. brooches, pendants, bracelets, earrings, etc. as well as custom-made products are handmade and may contain small imperfections.

4.14. The KAiDO Store reserves the right to change the prices of goods on offer. Prices of goods are binding from the moment of placing an order until its completion.

4.15. The use and processing of photos, text descriptions, or their fragments on the website without written permission is prohibited.

4.16. Each parcel with an order is sent a document confirming the purchase (proof of sale, receipt).

V. Deliveries

5.1 The Products are delivered to the address indicated by the Customer when placing an Order.

5.2 Delivery of the ordered Products is carried out by InPost (courier/parcel machine) and the Polish Post Office for orders outside Poland (please contact us before placing your order to check the delivery cost for the country indicated). Delivery costs are available on the Store's site under the link https://kaido.pl/platnosc_i_wysylka.  In addition, delivery costs shall be indicated while placing an Order.

5.3 Delivery time is from 3 to 4 working days in Poland from the date of sending the Order by the Customer. The lead time for orders outside Poland may vary depending on the country of dispatch.

Fixing, securing, making available, and confirming to the Customer the important provisions of the Sales Agreement of the Goods shall take place by sending to the Customer at the provided e-mail address and by attaching to the parcel containing the Goods a proof of sale.

VI. Prices and payment methods

6.1 The prices of the Goods shall be quoted in PLN.

6.2 The Customer shall have the possibility to pay the price:

a.) by bank transfer to the bank account number 90 1140 2004 0000 3202 6094 6396,

b.) payment via RevolutPay or PayPal

VII. Right of withdrawal

7.1 The Customer, who is a consumer within the meaning of Article 221 of the Civil Code, has the right to withdraw from a remote agreement, without giving any reason, by making a statement in writing within 10 days and sending it to the following address

7.2 The 10-day period is counted from the day of delivery.

7.3 In the case of withdrawal from the agreement concluded at a distance, the agreement is considered not concluded. What the parties have provided shall be returned unchanged, unless the change was necessary within the limits of ordinary management. The return should be made immediately, not later than 14 days. The purchased goods should be returned to the following address:

7.4 The Seller will return the shipping costs incurred by the Buyer for sending the purchased goods. However, if the Buyer chooses another cheaper method of delivery offered by KAiDO Store, the Store is not obliged to reimburse the additional costs incurred by the Buyer.

7.5 The returned goods must be accompanied by proof of purchase.

VIII. Complaints about the provision of electronic services

9.1. The KAiDO Shop takes steps to ensure the proper functioning of the Store to the extent resulting from current technical knowledge and undertakes to remove all irregularities reported by customers within a reasonable time.

9.2 The Customer is obliged to immediately notify the Store of any irregularities or interruptions in the operation of the Online Store service.

9.3 The irregularities associated with the operation of the Store the Customer can report in writing to the address: KAiDO Dorota Babral-Stankiewicz, Świętojańska 173A/9, 07-202 Wyszków, by email at sklep@kaido.pl or by using the contact form.

9.4 The Purchaser has the right to request that the product(s) advertised be brought into conformity with the contract by way of a free replacement. If the KAiDO Store is unable to meet the specified demands, the customer has the right to demand an appropriate reduction in price or withdraw from the contract.

9.5 Complaints concerning damage to shipments in transit must be made at the latest upon receipt of the goods. The recipient is obliged to draw up a complaint protocol with the participation of the courier company (signature required) and immediately notify the Store by e-mail. Complaints of not fulfilling the given procedure will not be taken into account.

9.6 In the complaint the Customer should give his name, mailing address, type, and date of an irregularity related to the operation of the Store.

9.7 The KAiDO Store undertakes to process each complaint within 14 days, and if this is not possible, to inform the Customer when the complaint will be processed.

IX. Final regulations

1. KAiDO store provides access to the website of the Online Store for reviews written by Customers. KAiDO store ensures that the published opinions come from Clients who have used or purchased the given product. Verification of the origin of opinions is done in such a way that: an opinion about a product can only be given by a registered and logged-in Customer on the website of the Online Shop.  Then, before publishing an opinion, the KAiDO store verifies that the respective Customer has actually purchased the product to which the opinion relates. Opinions from customers who do not pass this verification will not be made available on the Shop's website.

2. KAiDO Store undertakes to protect personal data in accordance with the Act of the 29th of August 1997. "On the protection of personal data".

3. Filling out the form with the Orderer's data is equivalent to consent to the storage and processing of personal data for the purpose of carrying out and settlement of transactions. The Buyer's personal data shall be processed solely for the purpose of carrying out the order placed, including issuing an invoice or bill and keeping financial records. These data are confidential and will not be disclosed to third parties. The customer has the right to inspect his own personal data and correct it, as well as remove it from the database. 4. Data concerning payment card numbers and bank accounts are unknown to the KAiDO Store. Authorization of electronic forms of payment takes place on the websites of the relevant banks, financial intermediary institutions, or Polcard companies.

5. In matters not covered by these terms and conditions, articles of the Civil Code apply.
